ARTICLE I

The Parties undertake to settle any international disputes in which they may be involved by peaceful means in such a manner that international peace and security and justice are not endangered and to refrain in their international relations from the threat or use of force in any manner inconsistent with the Purposes of the United Nations, or obligations assumed by any Party toward the United Nations.

ARTICLE II

The Parties will consult together whenever, in the opinion of either of them, the political independence or security of either of the Parties is threatened by external armed attack. Separately and jointly, by self help and mutual aid, the Parties will maintain and develop appropriate means to deter armed attack and will take suitable measures in consultation and agreement to implement this Treaty and to further its purposes.

ARTICLE III

Each Party recognizes that an armed attack in the Pacific area on either of the Parties in territories now under their respective administrative control, or hereafter recognized by one of the Parties as lawfully brought under the administrative control of the other, would be dangerous to its own peace and safety and declares that it would act to meet the common danger in accordance with its constitutional processes.

ARTICLE IV

The Republic of Korea grants, and the United States of America accepts, the right to dispose United States land, air and sea forces in and about the territory of the Republic of Korea as determined by mutual agreement.

ARTICLE V

This Treaty shall be ratified by the United States of America and the Republic of Korea in accordance with their respective constitutional processes and will come into force when instruments of ratification thereof have been exchanged by them at Washington.(2)

ARTICLE VI

This Treaty shall remain in force indefinitely. Either Party may terminate it one year after notice has been given to the other Party.

한미 상호 방위 조약  조문 입니다.   6 조를 보면  당사국은  상대국에게  통보를 한 후 1년이 지나면  조약을 폐기 시킬 수 있다고 나와 있습니다. 하지만  앞의 내용은  한미 상호 방위 조약의 효력 기간은  무기한 이라고 되어 잇네요. ㅋㅋ 

그리고  3조에 의해서  북한이나  중국의  핵미사일  또는 탄도 미사일에  대한 위협에 대해  공동으로 대처해야 하는 이유가  나와 있습니다.   한반도 지역에 국한되어 적용 되는 게 아니라   "an armed attack in the Pacific area on either of the Parties in territories now under their respective administrative control, or hereafter recognized by one of the Parties as lawfully brought under the administrative control of the other  "  이렇게  나와 있죠.   그래서  태평양 지역에 있는 괌 공군 기지나  일본 내에  주한 미군 기지에 대한 위협도  공동 대처할 의무가 생기는 겁니다.  

따라서  THAAD 배치가  미국에만  유리하다는 소리는  헛소리이고(조약위반)  정 맘에 안들면  국회에 청원해서   한미 상호 방위 조약  폐기 하라고 하면  THAAD 배치 할 필요 없이 1 년 후에   한미 상호 방위 조약 폐기 시킬 수 잇습니다.   

주한 미군 철수 하라고  백날  시위 해봐야   헛구호이고  국회의원들한테 청원이나 하세요.  그게  더 빠릅니다.    박근혜가   한미 상호 방위 조약 폐기 시킬 일은 없을 테니까.

그리고 북한 남침시에  자동 개입 조항은 없습니다.  제 2조의 "will take suitable measures in consultation "  때문입니다.    in consultation 은  미국의 경우에  미 의회에 파병 동의를 얻어야 한다는 의미 입니다.   

그래서  휴전선하고  서울 사이에  미군이  주둔해  있는 겁니다.   그 결과 현재 까지 Deterrence Force로  작용하고 있지요.

자동 참전 조항은 위 조문에 없습니다.   찾아 보세요 잇나?  절대로 없습니다.  그래서  주한미군이  휴전선 부근에 배치 되어 있엇고  박통 초기 시절에는   미 7 사단이 휴전선에 배치 되어서  북한이 남침하면  자동적으로 미군하고  전투를  벌이게끔 해서   자동 참전이 가능했던 겁니다.   

지금은   한강 이북에 있던  미군 기지를 다 평택으로 옮기는 중이라서   이후에는 인계 철선에 의한 자동 참전이 힘들 수도 있습니다.  예를 들면  서울만  북한군이 급습으로 점령하고 더 이상 남하 하지 않으면  미군이 자동참전이 안 될 수도 있습니다. 

미군의 정식 파병은 의회의 동의를 얻어야 합니다.  한국도  해외 파병은 의회의 동의를 얻어야 합니다.  그리고  미국이 한반도 이외의 지역에서  공격을 받았을 경우  한미 대통령간의  합의가 있어야  파병이 가능합니다.  그리고, 한국 국회의 동의도 받아야 하구요.
